1. Scope and applicability
These General Terms and Conditions (“GTC”) apply to purchases made by consumers via the website www.swissnutri.com of Swiss Nutri GmbH. These GTC govern the contractual relationship between Swiss Nutri GmbH and its customers (“you” or “the customer”) and form an integral part of every contract concluded via the website.
Orders may be placed from countries and regions to which delivery is offered during checkout. Available delivery destinations may change from time to time.
Purchases are permitted only for persons aged 18 or older.

3. Legal classification
Unless otherwise stated on the relevant product page, the products offered on this website are marketed as food supplements and not as medicinal products. They are not intended to diagnose, treat, cure or prevent any disease.
The classification, permitted sale, labelling and use of individual products may vary depending on the destination country. Products are offered only where Swiss Nutri GmbH considers their sale to be permitted under the applicable requirements.

4. Compliance with nutrition and health claims regulations
We aim to ensure that nutrition and health-related statements on our website comply with the laws and regulations applicable to the markets in which our products are offered, including applicable Swiss and European requirements.
Where European Union rules apply, nutrition and health claims are used in accordance with applicable EU food law, including Regulation (EC) No 1924/2006 on nutrition and health claims made on foods.
5. Information on ingredients and allergens
Ingredient lists, allergen information and other relevant product information are provided on the applicable product page and/or product packaging. Customers should review this information carefully before purchasing or using a product.

6. Usage restrictions and medical advice
Food supplements are not intended to replace a varied and balanced diet or a healthy lifestyle. Always follow the recommended use and warnings shown on the product label.
If you are pregnant, breastfeeding, taking medication, have a medical condition or are uncertain whether a product is suitable for you, seek advice from an appropriately qualified healthcare professional before use.
7. Storage instructions
Products should be stored according to the storage instructions shown on the relevant product label or packaging. Unless otherwise stated, products should generally be stored in a cool, dry place, protected from direct sunlight and kept out of reach of children.
8. Age restriction
The sale of our products is restricted to individuals aged 18 and older unless a different legal age requirement applies in the customer's country. By placing an order, you confirm that you satisfy the applicable age requirement.
Section 3: Purchase and contract terms
9. Conclusion of contract
The presentation of products on the website generally constitutes an invitation to place an order and not a legally binding offer.
By submitting an order, you make an offer to purchase the selected products. The purchase contract is concluded when we accept your order by sending an order confirmation or otherwise expressly confirming acceptance of the order.
We reserve the right to reject or cancel an order where reasonably necessary, including where a product is unavailable, payment cannot be authorised, delivery is unavailable to the specified destination, an obvious pricing or product information error has occurred, or fulfilling the order would violate applicable law.
10. Prices, taxes and charges
Product prices are displayed in the currency shown on the website or during checkout. Depending on the customer's location, prices may be displayed in Swiss francs (CHF), euros (EUR) or another supported currency.
Applicable taxes and shipping costs will be displayed during checkout where required. Any additional charges that are known and payable to Swiss Nutri GmbH will be communicated before the order is completed.
For international orders, the treatment of VAT, import duties, customs charges or other taxes may depend on the destination country and the shipping arrangement used for the order. Where such charges are not included in the price collected by Swiss Nutri GmbH, the customer may be responsible for paying them to the relevant authority or service provider.
11. Payment terms
Available payment methods are displayed during checkout and may vary depending on the customer's country, currency or device.
Payment must be completed using one of the payment methods offered during checkout. We reserve the right to take appropriate action in cases of suspected fraudulent or unauthorised transactions.
12. Shipping and delivery
We deliver to selected destinations throughout Europe. The countries currently available for delivery will be shown during checkout.
Delivery is made to the address provided by the customer during the ordering process. Estimated delivery times depend on the destination and will be communicated during checkout or after the order has been placed where available.
Delivery times are estimates unless expressly stated otherwise. Delays may occur due to circumstances outside our reasonable control, including customs procedures, public holidays, unusually high shipment volumes, stock shortages or other unforeseen circumstances.
Shipping costs are displayed during checkout before the order is completed.
For consumers benefiting from mandatory European consumer protection rules, the risk of accidental loss or damage generally remains with Swiss Nutri GmbH until the customer, or a third party designated by the customer other than the carrier, has received the goods, except where applicable law provides otherwise.
Customers are responsible for providing a complete and accurate delivery address. If an order cannot be delivered because the customer supplied incorrect or incomplete information, additional costs resulting from a new delivery attempt may be charged where permitted by applicable law.
13. Product availability
All orders are subject to product availability.
If an ordered product becomes unavailable, we may contact you and offer an alternative product. We will not substitute a materially different product without your agreement. If no suitable solution is agreed, the affected product or order will be cancelled and any amount already paid for it will be refunded.
14. Resale restriction
Products purchased through our consumer website are intended for personal use unless otherwise agreed in writing.
Commercial resale or distribution of our products may require prior written approval from Swiss Nutri GmbH. Retailers, pharmacies, distributors and other businesses interested in commercial partnerships should contact us directly.
Section 4: Customer protection and support
15. Product use and liability
Customers are responsible for using products in accordance with the instructions, warnings and recommended use stated on the relevant product packaging or product page.
Nothing in these GTC excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including mandatory consumer protection or product liability rules.
16. Satisfaction guarantee
We may offer an additional commercial satisfaction guarantee for certain products or purchases. Any such guarantee is subject to the conditions described on our Satisfaction guarantee page.
A voluntary satisfaction guarantee does not limit any mandatory statutory rights available to consumers.
17. Returns and right of withdrawal
Customers may have statutory cancellation, withdrawal or return rights depending on their country of residence and the applicable consumer protection laws.
For consumers in the European Union and other jurisdictions where equivalent rules apply, online purchases generally include a statutory right to withdraw from the contract within 14 days after receiving the goods, without providing a reason, subject to the exclusions and conditions provided by applicable law.
Certain products may be excluded from the statutory right of withdrawal where permitted by law, including certain sealed goods that are not suitable for return for health protection or hygiene reasons once the seal has been broken, or goods that deteriorate or expire rapidly.

Nothing in our return policy or these GTC limits mandatory rights relating to defective, damaged, incorrectly supplied or non-conforming goods.

Section 5: Legal provisions
19. Applicable law and jurisdiction
These GTC and contracts concluded with Swiss Nutri GmbH are governed by Swiss law, subject to any mandatory consumer protection provisions that apply in the customer's country of habitual residence and that cannot legally be excluded by agreement.
Where mandatory consumer protection legislation grants customers the right to bring proceedings before the courts of their country of residence, nothing in these GTC limits that right.
To the extent legally permitted and where no mandatory consumer jurisdiction rules apply, the competent courts at the registered office of Swiss Nutri GmbH shall have jurisdiction.
20. Intellectual property
Unless otherwise indicated, the content of this website, including text, graphics, branding, photographs, product images and other materials, is owned by Swiss Nutri GmbH or used with permission and may be protected by intellectual property laws.
Unauthorised reproduction, distribution or commercial use is prohibited except where permitted by applicable law.
21. Force majeure
Swiss Nutri GmbH is not responsible for delays or failure to perform obligations caused by events outside its reasonable control, to the extent permitted by applicable law.
Such events may include natural disasters, governmental measures, transport disruptions, strikes, pandemics, interruptions to infrastructure or other comparable circumstances.
This provision does not affect mandatory consumer rights.
22. Severability
If any provision of these GTC is found to be invalid or unenforceable, the remaining provisions will remain effective to the extent permitted by law.
The invalid or unenforceable provision will be interpreted or replaced in accordance with applicable law in a manner that most closely reflects its intended commercial purpose.
23. Amendments
We may amend these GTC from time to time to reflect changes to our services, business practices or applicable legal requirements.
The version of the GTC in effect when the customer places an order generally applies to that order. Changes will not retroactively alter an existing contract unless required by law or expressly agreed with the customer.
24. Language
These GTC may be made available in several languages. Where legally permitted, the German version is the reference version in the event of differences between translations.
This provision does not limit any mandatory language or consumer information requirements applicable in the customer's country.
25. Customer feedback and data use
If you voluntarily submit a review, testimonial, photograph, feedback or other content, we may use that content only in accordance with the rights granted by you, our applicable terms, data protection requirements and any consent required by law.
Where personal data is involved, its processing is governed by our Privacy policy.
26. Communication with influencers and third parties
Statements made independently by influencers, affiliates, reviewers or other third parties do not necessarily represent the views or claims of Swiss Nutri GmbH.
Where Swiss Nutri GmbH sponsors, commissions, approves or otherwise controls promotional communications, we require such communications to comply with applicable advertising, consumer protection and product-specific requirements.
